Terms of Use
These terms are an agreement between you and Cunto AI - Calorie tracker ("we", "us") for the Cunto AI mobile app. By installing or using the app you agree to them. If you do not agree, do not use the app.
1. What Cunto AI is
Cunto AI helps you track what you eat. You photograph, describe, scan or search for food, and the app estimates calories and nutrients using an AI model and public food databases. It then compares that with a daily target calculated from the details you give.
2. Not medical advice
Cunto AI is a general wellness tool. It is not a medical device and does not provide medical, nutritional or dietary advice. Nutrition estimates can be inaccurate, sometimes significantly. Always use your own judgement and consult a qualified professional before changing your diet, and do not use the app to manage a medical condition. If you have, or think you may have, an eating disorder, please seek professional help rather than using calorie-tracking apps.
3. Who can use it
You must be at least 13 years old. If you are under 18, use the app only with a parent or guardian's permission. You are responsible for keeping your device and account secure.
4. Accounts
The app creates an anonymous account automatically so your data can be backed up. You may attach an email address, Apple ID or Google account to it. You can delete your account at any time in Settings. We may suspend or close accounts that break these terms or abuse the service.
5. Cunto AI Pro subscription
- Some features require a paid subscription, "Cunto AI Pro", offered monthly or yearly. Prices are shown in the app before you buy and may vary by country.
- Where offered, a free trial lasts 3 days. If you do not cancel at least 24 hours before the trial ends, the subscription starts and you are charged.
- Subscriptions renew automatically at the end of each period at the then-current price, unless you cancel at least 24 hours before the period ends.
- Payment is charged to your Apple ID or Google Play account. You can manage or cancel the subscription in your device's subscription settings; deleting the app does not cancel it.
- Refunds are handled by Apple or Google under their rules. We cannot issue refunds for purchases made through them.
- If we change the price, you will be told in advance and can cancel before it applies.
On Apple devices, Apple's standard Licensed Application End User License Agreement also applies to the extent it is not inconsistent with these terms.
6. Fair use of the AI
Food recognition costs us money per request, so it is limited to a reasonable number of requests per person per day. Do not use automated tools, share accounts, or try to bypass the limit, reverse-engineer the app, or use the service for anything unlawful or unrelated to tracking food.
7. Your content
You keep ownership of the photos and text you provide. You give us permission to process them, including sending them to our AI provider, solely to run the app for you as described in the Privacy Policy. Do not upload photos of other people or anything you have no right to share.
8. Our content
The app, its design, its food database and its text in every language belong to us or our licensors. You may use the app for personal, non-commercial purposes only. Packaged-product data comes from Open Food Facts under its open licence.
9. Availability and changes
We may change, add or remove features, and we may stop offering the app. We try to keep the service available but cannot promise it will always work or be free of errors. Third-party services we depend on, such as the AI model, may be unavailable at times.
10. Disclaimer and limitation of liability
The app is provided "as is" without warranties of any kind, to the extent the law allows. We are not liable for any health outcome, decision or loss arising from your use of the app or reliance on its estimates. Where liability cannot be excluded, our total liability to you is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be limited by contract.
11. Ending the agreement
You can stop using the app and delete your account at any time. We may end or suspend your access if you break these terms. Sections 2, 7, 8, 10 and 12 survive termination.
12. Governing law
These terms are governed by the laws of the United States, and disputes will be heard in its courts, unless the consumer law where you live gives you other rights.
13. Changes to these terms
If we make meaningful changes, we will update the date at the top and notify you in the app. Continuing to use the app after that means you accept the new terms.
